Employment information

Jersey is not part of the UK and has its own legislation to deal with local needs and requirements for employment. There is a particular need to manage inward migration and limit the size of the resident population. Various measures have been put in place to assist in this area.  For example, under the Housing (Jersey) Law, 1949, only people with Jersey residential qualifications can purchase and lease private dwelling accommodation, and licences are required for all new businesses

The Regulation of Undertakings & Development (Jersey) Law, 1973, deals with the setting up of new businesses and the taking on of new staff.  It requires any trade, business or profession carried out in the Island, to have a licence before commencing or engaging additional staff.  Application forms are available from the Population Office, Jubilee Wharf, The Esplanade, St. Helier or by following this link.

This Law divides Jersey’s workforce into those who are locally qualified and those who are not. The main way to be considered locally qualified is to:

  1. Fall within any of the Housing Regulations A-K (as detailed below)
  2. Have been resident for the whole of the previous consecutive five years;

The current policy of the Population Office is to grant licences to people who are locally qualified. Non-locally qualified people can only commence a business, or be employed by firms, where it is shown that the business brings sufficient benefits to Jersey, and in the case of employment, where it is demonstrated that suitable local persons are not available.
