The Jersey Insurance Institute Seminar will investigate findings of The English & Scottish Law Commission’s joint Report and focus on new guidelines for insurance practitioners when dealing with the public.

The seminar, which will be held at the Victoria Club on 28th July, will feature a presentation by Jersey Solicitor Lee Ingram from Voisin law firm. He will speak to members of the Institute and hold a Q&A session on ‘A Question of Uberrima Fides’.

The Jersey seminar is particularly pertinent due to the release of the The English & Scottish Law Commission’s Joint Report, which explores the information that a consumer should tell an insurer when taking out an insurance policy.

Presently, insurers can refuse to pay a claim if a policyholder fails to disclose any relevant information, even if he answered all questions that were asked honestly and reasonably of him in the insurers proposal form. This increased duty sets insurance contracts apart from other consumer contracts. It is rarely explained to the policyholder but commonly relied upon to avoid payment of a claim.

At the seminar, Jersey insurance practitioners will discuss how the report relates to Jersey practice and the guidelines to be adopted. Lee Ingram, Solicitor, Voisin law firm, says:

The joint Report includes draft legislation, which represents a radical reform of this particular area of insurance law. It seeks to clarify existing rules and guidance, presently employed by insurers, to redress the deficiencies created by antiquated legal principles found in legislation which is now over 100 years old.’

The seminar will begin at 13:00 on 28 July at The Victoria Club and is due to finish before 14:00.
